Terms of Service

1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the DVLP Sports website (dvlpsports.com) and the DVLP Sports application (together, the "Service"), operated by DVLP Sports ("DVLP Sports," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
2. Who can use the Service
- You must be at least 13 years old to create your own account. If you're between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
- Any account for a player under 13 must be created and managed by a parent or legal guardian, consistent with our Privacy Policy.
- Coaches, organization administrators, and parents represent that they have the authority to submit information (such as assessments or team rosters) about the players connected to their account.
3. Early access and the current state of the Service
The Service is currently in early access. Features described on our website — including any marked "Coming soon" — are in development and may change, be delayed, or be discontinued. We provide the Service, including during early access, without warranty of any kind, express or implied, including as to availability, accuracy, or fitness for a particular purpose.
4. Accounts
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at hello@dvlpsports.com of any unauthorized use.
5. Parent and guardian responsibility
Where a parent or guardian creates or manages an account on behalf of a player under 18, the parent or guardian is responsible for providing accurate information, reviewing the player's profile and Development Data, approving connections to teams, coaches, and organizations, and managing the account until the player is old enough to take it over, consistent with the age requirements in Section 2.
6. Acceptable use
You agree not to:
- Provide false information about yourself, a player, a team, or an organization.
- Submit assessments, feedback, or ratings you know to be false or made in bad faith.
- Use the Service to harass, bully, or discriminate against any player, coach, or other user.
- Attempt to access accounts, teams, or data you're not authorized to access.
- Interfere with or disrupt the Service, or attempt to reverse-engineer it.
- Use the Service in violation of applicable law.
7. Development Data and ownership
- A player's profile and Development Data (assessments, feedback, scores, and history associated with that player) belong to the player — or, for a minor, the player's parent/guardian on the player's behalf — not to any single team, coach, or organization. Development Data follows the player if they change teams or organizations.
- Coaches and organizations can view, and where applicable submit, information for players connected to their team, but don't own the underlying player record.
- You grant DVLP Sports a license to host, store, and display the content and information you submit, solely to provide and improve the Service.
8. Fees
The Service is currently free during early access. If we introduce paid plans or features in the future, we'll provide advance notice before any charge applies to you.
9. Third-party services
The Service may let you connect information from third-party platforms — for example, video or statistics you already track elsewhere. We're not responsible for the practices or content of those third-party services, and your use of them is governed by their own terms.
10. Termination
You may stop using the Service and request deletion of your account at any time by contacting hello@dvlpsports.com. We may suspend or terminate access for any account that violates these Terms, poses a risk to other users (particularly minors), or for any other reason, with notice where reasonably practicable.
11. Disclaimers
The Service is provided "as is" and "as available." DVLP Sports doesn't warrant that the Service will be uninterrupted, error-free, or secure, and disclaims all warranties, express or implied, to the maximum extent permitted by law. DVLP Sports doesn't independently verify the accuracy of coach-submitted assessments or feedback.
12. Limitation of liability
To the maximum extent permitted by law, DVLP Sports and its founders won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service won't exceed the amount you paid us, if any, in the twelve months before the claim arose.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. If you're located in Canada or elsewhere, nothing in these Terms limits any consumer-protection rights you have under the mandatory laws of your own jurisdiction that can't be waived by agreement.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "last updated" date above and, where appropriate, notify you directly.
